These Terms & Conditions (“Terms”) govern your access to and use of the website arqvion.com and all related services (collectively, the “Platform”), operated by Arqvion (“Arqvion”, “we”, “us”, “our”), a real estate advisory and property-distribution network operating in India, with its head office at Opera House, Mumbai, Maharashtra.

By accessing the Platform, browsing property listings, registering an account, submitting an enquiry, or booking an appointment, you (“User”, “you”, “your”) agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please do not use the Platform.

1. Nature of Our Services

Arqvion is a real estate advisory and distribution platform that helps prospective buyers discover, compare, evaluate, and connect with developers, property owners, sellers, and channel/broker partners (collectively, “Advertisers”) for residential, commercial, villa, and land properties. Arqvion acts as a facilitator and advisory intermediary and is not a builder, developer, promoter, real estate agent of record, or a party to any transaction between a User and an Advertiser, unless expressly stated otherwise in writing for a specific engagement.

Nothing on the Platform constitutes a legal offer, a booking confirmation, or a binding agreement for the sale, purchase, or lease of any property. All property transactions occur directly between the User and the relevant Advertiser, and are subject to separate agreements executed between those parties.

2. Eligibility and Account Registration

You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 to use the Platform. When you register an account, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Arqvion reserves the right to suspend or terminate any account that provides false, misleading, or incomplete information.

3. Use of the Platform

You agree to use the Platform only for lawful purposes connected with genuine property search, advisory, or listing activity. You shall not:

• Post or transmit any content that is false, misleading, defamatory, obscene, unlawful, or infringes the rights of any third party.
• Use automated means (bots, scrapers, crawlers) to extract data, listings, or content from the Platform without our prior written consent.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity, including a property owner, builder, or agent.
• Use the Platform to send unsolicited commercial communication (spam) to other Users or Advertisers.
• Attempt to gain unauthorised access to the Platform, its servers, or any connected systems or networks.
• Upload viruses, malware, or any code of a destructive nature.
• Use the contact details or data of other Users obtained through the Platform for any purpose other than the specific property enquiry for which it was shared.

Arqvion reserves the right to remove any content, listing, or account, and to restrict or terminate access to the Platform, at its sole discretion, where it believes these Terms have been violated.

4. Property Listings and Third-Party Content

Property listings, prices, images, floor plans, availability status, and specifications displayed on the Platform are provided by Advertisers or aggregated from publicly available sources, and are updated on a periodic basis. While we take reasonable efforts to present accurate and current information, Arqvion does not independently verify, warrant, or guarantee the accuracy, completeness, legal title, RERA registration status, construction quality, or availability of any property listed on the Platform.

Users are strongly advised to independently verify all details of a property — including its RERA registration number (where applicable under the Real Estate (Regulation and Development) Act, 2016), title documents, approvals, carpet area, pricing, and possession timelines — directly with the relevant Advertiser and appropriate authorities before making any payment or entering into any agreement.

Arqvion does not endorse, and shall not be held responsible for, any pre-launch offers, investment schemes, or projects that have not received the requisite statutory sanctions or RERA registration. Users dealing in such projects do so entirely at their own risk.

5. Enquiries, Appointments and Consent to Contact

When you submit an enquiry, complete the “Book Appointment” form, or otherwise express interest in a property or service through the Platform, you authorise Arqvion to:

• Contact you via phone call, SMS, WhatsApp, or email regarding your enquiry, including where your number is registered under the National Customer Preference Register (NCPR) / Do Not Disturb (DND) registry.
• Share your name, contact details, and enquiry information with the relevant Advertiser(s), and, where applicable, home-loan or financing partners, so that they may respond to you directly.

Arqvion is not responsible for the conduct, communication, application forms, screening questions, or any subsequent dealings between you and an Advertiser once your enquiry has been shared. Any dispute arising from such interaction must be resolved directly between you and the concerned Advertiser.

6. Fees and Payments

Browsing listings and submitting standard enquiries on the Platform is free of charge for property buyers. Where Arqvion offers any paid advisory, concierge, or value-added service, the applicable fees, payment terms, and refund conditions (if any) will be communicated to you separately in writing before the service is rendered, and such payments shall be governed by the specific service agreement in addition to these Terms. Any amount paid to Advertisers directly (booking amounts, token money, or purchase consideration) is a matter strictly between the User and the Advertiser, and is not collected, held, or refunded by Arqvion.

7. Intellectual Property

The Platform, including its design, layout, text, graphics, logos, the “Arqvion” name and mark, and underlying software, is the property of Arqvion or its licensors and is protected under applicable Indian intellectual property laws. Property images, brochures, and project content remain the property of the respective Advertisers. You may not copy, reproduce, republish, frame, or create derivative works from any part of the Platform without prior written permission, except for your own personal, non-commercial use in connection with a genuine property search.

8. Third-Party Links

The Platform may contain links to third-party websites, social media pages, payment gateways, or embedded content, provided for convenience. Arqvion does not control and is not responsible for the content, policies, or practices of any third-party website, and inclusion of such a link does not imply endorsement.

9. Disclaimer of Warranties

The Platform and all content, listings, and advisory information are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Arqvion does not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. Arqvion does not guarantee any particular outcome, response, or result from listing a property or submitting an enquiry on the Platform.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Arqvion, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform, your reliance on any listing or information, or any transaction or dispute with an Advertiser, even if advised of the possibility of such damages. Arqvion’s total aggregate liability arising out of or relating to these Terms or the Platform shall not exceed the amount, if any, paid by you to Arqvion directly for the specific service giving rise to the claim in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Arqvion and its directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of a third party, including an Advertiser or another User.

12. Suspension and Termination

Arqvion may, at its sole discretion and without prior notice, suspend, restrict, or terminate your access to the Platform or any account if it reasonably believes you have violated these Terms, engaged in fraudulent or unlawful activity, or misused the Platform in a manner that may harm other Users, Advertisers, or Arqvion. You may stop using the Platform and request closure of your account at any time by contacting us using the details in Section 15.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to Section 14 below, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or your use of the Platform.

14. Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, including its formation, interpretation, breach, or termination, which cannot be resolved through good-faith negotiation within thirty (30) days, shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed mutually by the parties. The seat and venue of arbitration shall be Mumbai, Maharashtra, and the language of arbitration shall be English. The arbitral award shall be final and binding on both parties.

16. Changes to These Terms

Arqvion reserves the right to modify or update these Terms at any time, at its sole discretion, to reflect changes in our services, business practices, or applicable law. The “Last Updated” date at the top of this document indicates when these Terms were last revised. Your continued use of the Platform after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

17. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable by a court or arbitral tribunal of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arqvion regarding your use of the Platform, and supersede any prior agreements or understandings, whether written or oral.
